Terms & Conditions
for Professionals

These Terms & Conditions govern the use of ClearShift by hospitality professionals. By registering with or accepting opportunities via ClearShift, you agree to the terms below.

1. ClearShift’s Role

ClearShift is not an employer, recruitment agency, or labour broker. ClearShift acts as a connector and coordinator, introducing hospitality professionals to establishments seeking support and assisting with coordination and clarity upfront. All working relationships, payments, and employment arrangements are directly between you and the establishment.

2. Eligibility & Registration

By joining ClearShift, you confirm that:

ClearShift reserves the right to accept or decline registrations at its discretion.

3. Types of Work

Opportunities shared via ClearShift may include:

ClearShift does not guarantee the availability or frequency of work.

4. Shifts, Roles, and Acceptance

You are free to accept or decline opportunities shared with you. Once you accept a shift or role, you commit to attending as agreed. Any changes to availability must be communicated as early as possible. Repeated late cancellations or no-shows may result in removal from the ClearShift network.

5. Trial Shifts

Some establishments may request a trial shift or short assessment period before confirming a role. The terms of any trial shift, including whether it is paid and the agreed rate, are arranged directly between you and the establishment. The establishment is responsible for paying you for any trial work performed. ClearShift may assist with coordination but does not negotiate or process trial payments.

6. Payment

You are paid directly by the establishment, not by ClearShift. Rates, payment timing, and any tips are agreed between you and the establishment. ClearShift is not responsible for wage payments, disputes, or delays. If payment issues arise, they must be resolved directly with the establishment. ClearShift will assist with follow-up where possible, but cannot guarantee payment outcomes.

7. Conduct & Professionalism

Professionals are expected to:

ClearShift reserves the right to remove professionals from the network where conduct falls below expected standards.

8. Health, Safety & Compliance

You are responsible for complying with applicable health and safety requirements, holding any required certifications or permits, and working within the law at all times. ClearShift does not supervise or control on-site work.

9. Liability

ClearShift is not liable for any injury, loss, or damage arising during a shift or engagement, disputes between you and an establishment, or termination of engagements by an establishment. ClearShift’s role is limited to introduction and coordination.

10. No Exclusivity

Registration with ClearShift is non-exclusive. You are free to seek work through other channels.

11. Changes to Terms

ClearShift may update these Terms & Conditions from time to time. The latest version will be available on the ClearShift website.

12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.
